Para Schietti, manter a prisão representaria uma antecipação da pena. Para o ministro, as acusações contra o ex-governador do Rio são graves, mas os crimes de corrupção teriam ocorrido até 2016, e os de lavagem de dinheiro até 2007. Assim, no entendimento dele, não haveria fatos atuais que justificassem a prisão. Além disso, Pezão não tem mais cargo público e não há elementos de que a suposta organização criminosa ainda esteja em funcionamento. No caso de Pezão, a Sexta Turma considerou que não havia "sinais de relevante alteração patrimonial ou de estilo de vida típico de pessoas que ocupam postos de liderança em esquemas de corrupção". Para o ministro, as acusações contra o ex-governador do Rio são graves, mas os crimes de corrupção teriam ocorrido até 2016, e os de lavagem de dinheiro até 2007.
Assim, no entendimento dele, não haveria fatos atuais que justificassem a prisão. Além disso, Pezão não tem mais cargo público e não há elementos de que a suposta organização criminosa ainda esteja em funcionamento.
No caso de Pezão, a Sexta Turma considerou que não havia “sinais de relevante alteração patrimonial ou de estilo de vida típico de pessoas que ocupam postos de liderança em esquemas de corrupção”. Os ministros também levaram em consideração problemas de saúde do ex-governador.
