"articleBody": "O Ministério Público do Estado do Rio de Janeiro (MPRJ) obteve no sábado decisão judicial que determina que a Secretaria de Estado de Educação suspenda a reabertura das escolas da rede estadual de ensino para a oferta de alimentação escolar, que estava programada para a esta segunda-feira (8). O motivo alegado é o “alto risco de contágio a que a comunidade escolar estaria submetida, devido à atual pandemia do novo coronavírus”. Em caso de descumprimento, foi fixada multa diária no valor de R$ 5 mil ao secretário estadual de Educação, Pedro Fernandes, e ao governador Wilson Witzel. A decisão foi proferida sobre requerimento do MPRJ, interposto na sexta-feira, com a alegação de que a programação da reabertura das escolas contraria decisão judicial que determinou a oferta de alimentação através da distribuição de gêneros alimentícios ou transferência de renda. A decisão determina, ainda, que no caso de distribuição de gêneros, deverão ser indicados dias, horários e locais nos quais os responsáveis poderão comparecer para retirada, em observância das medidas sanitárias aplicáveis. O juiz Sérgio Luiz Ribeiro de Souza ressaltou que “o motivo elencado para reabertura das escolas estaduais é a decisão de natureza liminar; Ocorre que em nenhum momento a decisão em comento determinou ou ao menos autorizou que o cumprimento da obrigação fixada fosse executado com a abertura das unidades escolares em desconformidade com as regras sanitárias”. O magistrado afirmou também que “a fundamentação do Decreto Estadual n.47.105/2020 evidencia erro grosseiro porque totalmente dissociada do evidente conteúdo de ambas as decisões judiciais citadas na motivação”, descreveu ele, , destacando os termos da Medida Provisória 966/2020. Ainda segundo a decisão, “observa-se que trata-se de transferência de renda ou entrega de gêneros alimentícios, sempre com observância das medidas sanitárias aplicáveis. As medidas restritivas de circulação impostas pelo Estado do Rio de Janeiro, com fulcro na proteção de saúde da população, incluíram o fechamento das escolas e a suspensão das aulas. Essa medida restritiva ainda está vigendo porque a alta istração estadual, naturalmente com fundamento técnico, entende não ser o momento de retomada das aulas sem a imposição de risco exagerado para a saúde e a vida da população".
